    Who has heard of the New Jersey "Dirty Dirt Law"? I'm guessing most of you haven't and may ask why does it matter? Soils or fill materials are routinely trucked to sites being developed throughout the state as well as to established residential sites. Clean soil is fine, but sometimes soil or fill material which is sold or offered free of charge - advertised as “free clean fill” - may contain debris or contaminants that should not be on residential property. Even material that you may get from your local landscape supply store, Class B recycling facility, or landscaper may look clean but may contain contaminants that are above residential standards. That is where the "dirty dirt law" comes into play. As a property owner, you are responsible for knowing the disposition of soil/material that is delivered to your property. Many times, contracts are entered into that specify certified clean fill is to be delivered to your property which offers some legal recourse. However, many times, common fill, screened fill, or fill dirt is specified or acquired through shady sources. It's only after the fact where you may learn that the material originated from known or suspected contaminated Sites.     Now that football season is officially over 😪, we now enter another season. Peak home buying/selling season! 😀 With today's housing market, many prospective purchasers are faced with all cash offers and offers far in excess of the asking price! Many sellers are requesting quick closings with no inspections! GKL Environmental Consulting LLC's recommendation is run if they are asking for no inspections. It is one of the few times that you can inspect the largest purchase/investment of your life before actually signing on the dotted line and is the time when many potential future issues are identified.     On Wednesday January 31, 2024, The NJDEP released a document titled the Licensed Site Remediation Professional (LSRP) Supplemental Certification for Initial Soil Remedial Action Permit (RAP) Application. This was released in an attempt to reduce the time required for the NJDEP to review and approve Soil RAP applications, which currently typically takes anywhere from 6-18 months, although they are supposed to be completed within 120 days. Hopefully this new certification will aid the LSRPs in more quickly closing out cases where simple RAP applications have been or will be submitted.     On Tuesday, January 2, 2024, the New Jersey Department of Environmental Protection (“NJDEP”) announced its proposal to amend the Ground Water Quality Standards (“GWQS”) under N.J.A.C. 7:9C to change the ground water quality criteria for 65 constituents of Class II-A ground water. NJDEP is also proposing to amend the Remediation Standards under N.J.A.C. 7:26D-7.2(b) to allow NJDEP to update attendant remediation standards when the department modifies or adds a ground water quality criterion. The New Jersey Water Pollution Control Act authorizes NJDEP to adopt GWQS, which are used for permitting, remediation and enforcement decisions. NJDEP is proposing to amend these standards to update ground water quality criteria for 73 constituents of Class II-A ground water. This will change 65 constituent standards, making 50 more stringent, 13 less stringent, and two with interim generic criteria will be replaced with specific ground water quality criteria. In addition, the seven (7) compounds below have proposed reductions in their standards greater than an order of magnitude. This would trigger the “order of magnitude“ provision of the Brownfield and Contaminated Site Act, which may require entities or individuals responsible for remediation of a contaminated site to perform more extensive remediation, even if the Site was previously remediated!     What is this crazy contraption you may ask? While the responsibility of an LSRP is not just to collect data, it is also to collect the best quality data so sound decisions can be made regarding the investigation and remediation of a contaminated Site. That is why the helium leak check is so important when collecting sub slab vapor samples. The helium leak check ensures that you have an adequate seal for the sample which ensures that there is not a short circuit of the sample and to make sure that it is actually sub slab vapors that you are sampling and not indoor air making its way into the sub slab environment.It is in your best interest to make sure you have the highest quality data available so sound decisions can be made!
